Judge declines to apply ‘subject-matter waiver' in business spat
Day Pitney Litigation Partner Jonathan Handler was recently featured in the Massachusetts Lawyers Weekly article, “Judge declines to apply ‘subject-matter waiver’ in business spat.” The article discussed a Superior Court ruling that limited the scope of attorney-client privilege waiver, rejecting a request that would have made all of the plaintiff’s attorney communications discoverable.
Handler described the decision as a “thoughtful opinion,” noting that while the plaintiff had already been sanctioned for spoliation, the court resisted imposing additional penalties and instead addressed each issue on its own.
