Forfeiture and the Eighth Amendment

Dan Wenner and Stan Twardy authored an article, "Forfeiture and the Eighth Amendment," published in the January/February issue of GPSolo Magazine, a publication of the American Bar Association. The article discusses how the U.S. Supreme Court decision in United States v. Bajakajian provided a framework for how lower courts should determine whether the forfeiture component of a defendant's sentence violates the Eighth Amendment.
