Attys Navigate Tangle Of Transit-Oriented Zoning In Miami

Day Pitney Miami Land Use Partner Steven Wernick was featured in Law360 discussing Miami’s new Transit Station Neighborhood District zoning program, designed to compete with county and state efforts in Florida to spur development around current and future rail stations.

In the article, Wernick coins the term “3-D Zoning” to capture the emerging order in South’s Florida regulatory landscape – and how overlapping city, county, and state regulations create new opportunities for developers seeking approvals for new housing and transit oriented development.

Wernick explained that the TSND legislation is a direct response to Florida’s Live Local Act and expanding Rapid Transit Zones in Miami-Dade County, inviting developers to build with greater density and height in exchange for modest commitments to affordable housing and other community benefits tailored to the surrounding neighborhood.

He explained Miami’s new 3D zoning framework “creates more analysis that really needs to be thorough, but could end up giving [developers] more opportunities and the ability to design a project much differently than they would under the underlying zoning.”
